User Agreement for the Use of the Website https://buypet.org

This User Agreement governs the use of the online resource located at https://buypet.org (hereinafter referred to as the "Site") between https://buypet.org (hereinafter referred to as the "Service Provider") and any legal entity or individual using the Site for the purposes of searching, viewing, and/or posting Ads (hereinafter referred to as the "User").

By registering on the Site or using the Site for searching/viewing Ads, the User agrees to this User Agreement (hereinafter referred to as "UA") and assumes the rights and obligations specified therein related to the use of the Site.

1. Subject of the Agreement

1.1. The Service Provider offers its services to you under the terms outlined in this User Agreement.

1.2. The User Agreement may be amended by the Service Provider without notice. The new version of the User Agreement takes effect from the moment it is posted on the Site unless otherwise stipulated by the new version of the UA.

1.3. The current version of the UA, as well as other documents regulating the rules for using the Site and the provision of the Site's services, is always available on the Site and accessible to all Users.

2. Description of Services

2.1. The Site is an online platform that allows the User, at their own risk, to post offers addressed to an indefinite number of persons to engage in transactions concerning Goods that the User is authorized to dispose of (make offers). Other users of the Site may accept or reject these offers at their discretion and under their responsibility, conclude or not conclude the relevant transaction with the User who posted the Ad on the Site. The Service Provider is not, and cannot be, considered as an organizer of the transaction, buyer, seller, intermediary, agent, or representative of any Site user and/or any other interested party concerning the proposed/ongoing transaction between Site users. All transactions made possible by the posting of Ads by the User on the Site are concluded and executed without the direct or indirect participation of the Service Provider.

2.2. The Service Provider does not guarantee that any offers made to Site users through Ads posted on the Site or using the contact information contained in the Ad will be received and considered by other Site users.

2.3. The User agrees to exercise due diligence when choosing a counterparty, makes a decision about the transaction at their own risk, and independently ensures that the offer contained in the Ad on the Site is valid and lawful.

2.4. The Service Provider also provides paid services through the Site, which are regulated by a public Offer - https://buypet.org/eng/oferta.

2.5. The provision of paid services on the Site is regulated by the public Offer - https://buypet.org/eng/oferta, with which the User agrees when paying for paid services.

**3. Rights and Obligations of the Service Provider**

3.1. Rights

3.1.1. Information submitted to the Site is considered the property of the Service Provider. The Service Provider is under no obligation to ensure the confidentiality of such information unless there is a written agreement with the User to the contrary or if required by applicable law.

3.1.2. Information contained on the Site may not be reproduced or used for publication without the written permission of the Service Provider unless otherwise explicitly stated on the page containing such information. Copying of information contained on the Site may be done only by individuals for personal use.

3.1.3. Under no circumstances shall the Service Provider be liable for damages, losses, or expenses arising in connection with the use or inability to use the Site.

3.1.4. The Service Provider has the right at any time, at its discretion, to conduct selective checks of Ads for compliance by the User with this UA, including in an automated manner using software tools. If violations are detected, including complaints from third parties about such violations, the Service Provider has the right to assess the quality of Ads, their compliance with the requirements of this UA and the laws of the Republic of Kazakhstan, suspend or terminate the User's access to certain services of the Site, including rejecting or blocking Ads and/or User access to the personal account without notifying the User. The blocking of Ads and/or User registration data on the Site may be temporary or permanent, depending on the scope and frequency of violations of this User Agreement and other rules established by the Service Provider for the use of the Site. If the User corrects the violations, the Service Provider has the right to restore the previously blocked Ad or the User's access to the personal account.

3.1.5. The Service Provider has the right to unilaterally amend this UA and other documents governing the rules for using the Site and the provision of the Site's services. The new version of these documents takes effect from the moment it is posted on the Site unless otherwise provided by the new version of the respective document.

**3.2. Obligations**

Within this User Agreement, the Service Provider undertakes to:

3.2.1. Provide the User with the opportunity to post Ads on the Site, search for Ads from other users, located in the Site's database, in accordance with the rules and restrictions established by the Service Provider at any given time.

3.2.2. Provide the User with the ability to manage access to their Ad and set other options available to Users at a given time through their personal account.

3.2.3. Allow the User to delete their Ad and/or registration data at any time at their discretion.

3.2.4. Allow the User to completely delete all information they have posted on the Site through the personal account on the Site at any time at their discretion.

4. User Obligations Upon Registration

As part of this User Agreement, the User undertakes to:

4.1. Know and comply with the Rules for Posting Ads, which are an integral part of this UA.

4.2. Not to post any information through the Site in violation of the laws of the Republic of Kazakhstan and international law.

4.3. Not to post knowingly false information.

4.4. Not to post and/or transmit, using the Site, materials and/or Goods if the User does not have the corresponding rights to do so. This applies to materials protected by copyright, trademarks, patents, as well as confidentiality agreements, goods that require special permits for their sale, if such permits are absent, and similar.

4.5. Not to violate the information security of the Site.

4.6. Not to introduce executable code on the User's side, any embedded objects, use frame and iframe, cascading style sheets, HTML code.

4.7. Not to impersonate another person or on behalf of another person (individual or organization). Not to mislead other users and the Site administration regarding their identity in any way.

4.8. Not to destroy and/or modify any materials on the Site that the User is not the author of.

4.9. Not to use information about phone numbers, postal addresses, email addresses for purposes other than those related to the Site (search, view, and posting Ads).

4.10. Not to register using another person's email address or an address that the User has no right to use.

4.11. Not to share the password to access the personal account with third parties. The User is fully responsible for any damage caused to them by third parties due to the intentional or unintentional sharing of the personal account password with another person. The User is responsible for keeping the password confidential and for any use of the Site via their password.

4.12. By registering on the Site, the User agrees to receive informational and promotional messages from the Service Provider and its partners to the email address provided by the User, which can be unsubscribed from by clicking the "unsubscribe" button.

4.13. When visiting the Site, the User's cookie files are saved to analyze User behavior on the Site, determine the User's interest, and optimize advertising campaigns. A cookie file is a text file sent by a web server and stored on the User's computer, used for User authentication, session tracking, and storing statistics about the use of websites on the Internet. By visiting the Site, the User agrees to save their cookie files and transmit them to third parties to analyze User behavior on the Site and receive targeted advertising messages. The User agrees to receive targeted advertising according to the data processed from their cookie files. The User can refuse the storage of cookie files by changing the settings in the privacy/personal data parameters of the web browser they use.

5. Rules for Posting Ads on the Site

5.1. The responsibility for the accuracy of the information contained in Ads lies with those who place them (users who post Ads). The Service Provider is not obliged to pre-check Ads posted and/or distributed by the User through the Site. The User acknowledges and agrees that they must independently assess all risks associated with the posting, distribution, and searching of Ads, including the assessment of reliability, completeness, or usefulness.

5.2. The Service Provider reserves the right at its discretion to refuse to allow the User to post and/or distribute Ads and to delete Ads from the Site without prior notice to the User and without explanation.

5.3. The Service Provider may change the requirements for the content and conditions for posting Ads.

5.4. The Service Provider reserves the right to edit Ads to make them more reader-friendly.

5.5. The Service Provider reserves the right not to correspond with the authors of Ads.

5.6. By posting an Ad on the site that contains an image (including a photograph), the User grants the Service Provider the right to use the image (open license for the use of a work of art) in the following ways:

* as provided by Article 1270 of the Civil Code of the Russian Federation;
* placement and distribution on the Internet and/or using email among third-party Internet users. The

 period of use of the image is limited by the term of placement of the corresponding Ad on the Site.

The Service Provider is not obligated to provide reports on the use of the image.

5.7. The Ad posted by the User is considered an invitation to make offers from third parties regarding the conclusion of a deal on the terms specified in the Ad.

5.8. The Ad must fully comply with all the rules of the Service Provider.

5.9. The User agrees to provide truthful information about the objects in the Ads they post on the Site. The User guarantees that the Goods, the offer of which they place on the Site, meet the quality standards established by the legislation of the Republic of Kazakhstan and the legislation of the country where the Buyer is located, and that the Goods are free from the rights of third parties. In addition, the User guarantees that the offer to conclude a deal on the terms set forth in the Ad does not violate the legally protected rights and interests of third parties and the current legislation of the Republic of Kazakhstan. The User guarantees that they have all the necessary rights to post the Ad on the Site.

5.10. The User is obliged to use the personal account only for the purpose of posting, editing, and deleting Ads on the Site. The User guarantees that they are the owner of the phone number they provide in the personal account, which will be used for verification.

5.11. The User is prohibited from posting Ads about the sale of Goods that are not in stock or for the sale of which they do not have the necessary rights (powers).

6. Use of the Site

6.1. The Site, like all software, may contain errors. By using the Site, the User agrees that they are using the Site "as is" and assume all risks associated with its use. The Service Provider disclaims any warranties of any kind, express or implied, including, without limitation, implied warranties of merchantability or fitness for a particular purpose.

6.2. The Service Provider disclaims any responsibility for any information posted on the Site by the User, as well as the actions of Users.

7. Termination of the Agreement

7.1. The Service Provider may terminate this Agreement at any time and for any reason, including, but not limited to, violation of the terms of this Agreement or other actions that may be deemed by the Service Provider as a violation of the Agreement or any policies.

7.2. The User can terminate this Agreement by discontinuing the use of the Site and deleting their personal account.

8. Contact Informatio

8.1. Since the User independently, at their own discretion, and without any control from the Service Provider, posts Advertisements on the Site, which may be of an advertising nature, the User is considered an advertiser and distributor of all Advertisements posted by them on the Site, with all the resulting consequences as provided by the Federal Law "On Advertising" and the Code of Administrative Offenses of the Republic of Kazakhstan.

8.2. By posting Advertisements on the Site, the User guarantees that they have the right to sell the Goods specified in the advertisement, including that the Goods have undergone mandatory certification (if required by law for such type of goods). The User is solely responsible for any violation of the guarantees specified in this clause. The Service Provider has the right to request supporting documents for the Goods (including a declaration/certificate of conformity) specified in the relevant Advertisement. If the User fails to provide supporting documents for the goods, the Service Provider has the right to remove the corresponding advertisement from the Site without any penalties being applied to the Service Provider.

8.3. The User is responsible for ensuring that the content of their posted Advertisement complies with the current laws of Kazakhstan, including but not limited to the "Law on Employment in the Republic of Kazakhstan," "Law on Advertising," and the "Law on Protecting Children from Information Harmful to Their Health and Development." In the event that third parties (including but not limited to government agencies) make claims against the Service Provider regarding the Advertisements posted by the User and/or the Goods specified in the relevant Advertisement, the User agrees to independently and at their own expense resolve such claims. Should the Service Provider incur losses in connection with the aforementioned claims, the User agrees to fully compensate the Service Provider for such losses.

8.4. Given the technical difficulties in identifying users of Internet sites, the Service Provider is not responsible for ensuring that registered users are who they claim to be and bears no responsibility for any potential damage caused to the User or others for this reason.

8.5. By using information from the Site, the User acknowledges and accepts the risks associated with the potential inaccuracy of the information posted on the Site, as well as the possibility that some information may appear threatening, offensive, knowingly false, rude, or obscene, and independently decides whether or not to continue using the Site.

8.6. The Service Provider does not guarantee that the Advertisements posted by the User will be viewed by a certain number of users of the Site or even by any users at all

8.7. The Service Provider does not guarantee that the software, servers, and computer networks used by the Site are free from errors and computer viruses. If the use of the Site results in data loss or equipment damage, the Service Provider is not responsible for it.

8.8. The Service Provider reserves the right, at its sole discretion, to terminate the access of a User who violates this User Agreement and/or the terms of other rules for using the Site or posting Advertisements, either in whole or in part, including terminating or temporarily suspending the User's access to their personal account.

8.9. All disputes arising under this User Agreement shall be resolved in court at the location of the Service Provider in accordance with the laws of the Republic of Kazakhstan. This agreement cannot be interpreted as establishing agency relationships, partnerships, joint ventures, personal employment relationships, or any other relationships between the Service Provider and the User that are not explicitly provided for in this agreement.
