User Agreement for Using the Website https://buypet.org

 

This User Agreement governs the use of the online resource located at https://buypet.org (hereinafter referred to as the "Website"), between https://buypet.org (hereinafter referred to as the "Service Provider") and any legal or natural person using the Website for the purpose of searching, viewing, and/or posting advertisements (hereinafter referred to as the "User").

 

By registering on the Website or using the Website to search/view ads, the User agrees to this User Agreement (hereinafter referred to as the "UA") and assumes the rights and obligations specified therein regarding the use of the Website.

1. Subject of the Agreement

1.1. The Service Provider offers its services to the User under the terms outlined in this User Agreement.

1.2. The User Agreement may be amended by the Service Provider without prior notice. The new version of the User Agreement becomes effective upon its publication on the Website unless otherwise specified by the new version of the UA.

1.3. The current version of the UA and other documents governing the rules for using the Website and providing Website services are always available on the Website and accessible to all Users.

2. Description of Services

2.1. The Website is an online platform that allows Users, at their own risk, to post offers addressed to an indefinite number of people for transactions regarding goods they are authorized to manage (make offers for). Other Users of the Website may accept or reject these offers at their discretion and risk, and may or may not conclude the relevant transaction with the User who posted the ad. The Service Provider is not and cannot be considered the organizer of the transaction, buyer, seller, intermediary, agent, or representative of any User or other interested party regarding the proposed/current transaction between Website Users. All transactions conducted through ad postings by Users on the Website are concluded and performed without the direct or indirect involvement of the Service Provider.

2.2. The Service Provider does not guarantee that any offers made to Website Users through ads posted on the Website or using contact information contained in the ads will be received and considered by other Users.

2.3. The User agrees to exercise due diligence in selecting a counterparty, make transaction decisions at their own risk, and independently verify the validity and legality of the offer in the ad.

2.4. The Service Provider also offers paid services through the Website, governed by a public offer – https://buypet.org/oferta.

2.5. The provision of paid services on the Website is regulated by the public offer – https://buypet.org/oferta, which the User agrees to when paying for paid services.

3. Rights and Obligations of the Service Provider

3.1. Rights

3.1.1. Information provided on the Website is considered the property of the Service Provider. The Service Provider is not obligated to ensure the confidentiality of such information unless a written agreement with the User is in place or it is required by applicable law.

3.1.2. The information contained on the Website may not be reproduced or used for publication without written permission from the Service Provider, unless explicitly stated on the page containing such information. Copying information from the Website is allowed only for personal use by individuals.

3.1.3. Under no circumstances shall the Service Provider be liable for damages, losses, or expenses incurred in connection with the use or inability to use the Website.

3.1.4. The Service Provider has the right at any time, at its discretion, to conduct selective checks of advertisements for compliance with this UA, including automated checks using software tools. If violations are detected, including complaints from third parties, the Service Provider has the right to assess the quality of the ads, their compliance with this UA and Russian Federation law, suspend or terminate the User's access to certain services of the Website, including rejecting or blocking ads and/or the User's access to their account without notice. Blocking may be temporary or permanent, depending on the scale and frequency of violations. If the User corrects the violations, the Service Provider may restore the previously blocked ad or account access.

3.1.5. The Service Provider may unilaterally amend this UA and other documents governing the use of the Website and its services. The new version becomes effective upon publication unless otherwise stated.

3.2. Obligations

Under this UA, the Service Provider undertakes to:

3.2.1. Provide the User with the ability to post ads, search other users' ads in the Website database, according to the rules and restrictions set by the Service Provider.

3.2.2. Provide the User with the ability to manage access to their ad and configure other available settings via the personal account.

3.2.3. Allow the User to delete their ad and/or registration data at any time.

3.2.4. Allow the User to fully delete all posted content via the Website's personal account at any time.

4. User Responsibilities During Registration

As part of this User Agreement, the User agrees to:

4.1. Be familiar with and comply with the Posting Rules, which form an integral part of this Agreement.

4.2. Not post information that violates the laws of the Republic of Kazakhstan or international law.

4.3. Not post knowingly false information.

4.4. Not post and/or transmit materials or goods through the website unless the User has the appropriate rights to do so. This includes copyrighted materials, trademarks, patents, trade secrets, goods requiring special permits for sale (if such permits are not available), and more.

4.5. Not compromise the site's information security.

4.6. Not embed executable code, any embedded objects, frames or iframes, cascading style sheets, or HTML code.

4.7. Not impersonate another individual or act on behalf of another person (individual or legal entity). Not mislead other users or the site administration regarding their identity.

4.8. Not delete and/or modify any materials on the site unless the User is the author.

4.9. Not use contact details (phone numbers, postal addresses, emails) for purposes unrelated to the site (such as ad searching, viewing, and posting).

4.10. Not register using another person’s email address or an email the User has no right to use.

4.11. Not share the password for the personal account with third parties. The User is fully responsible for any harm caused by intentional or accidental password disclosure.

4.12. By registering, the User agrees to receive informational and promotional messages from Support and its partners. Users can unsubscribe at any time by clicking the "unsubscribe" button.

4.13. When visiting the site, cookies are stored on the User's device for behavioral analytics, interest profiling, and ad campaign optimization. By visiting the site, the User agrees to allow cookies to be stored and shared with third parties for personalized advertising purposes. Users may disable cookies via browser privacy settings.

5. Ad Posting Rules on the Website

5.1. Users are solely responsible for the accuracy of the information in their ads. Support is not obliged to pre-moderate ads. Users acknowledge that they must independently assess all risks associated with posting, distributing, and searching for ads.

5.2. Support reserves the right to refuse, at its sole discretion, to post or distribute ads and may remove ads without prior notice or explanation.

5.3. Support may amend content requirements and posting conditions.

5.4. Support may edit ads to improve readability.

5.5. Support is not obligated to correspond with ad authors.

5.6. By posting an ad containing an image (including photos), the User grants Support the right to use the image (open license to use the artwork) in accordance with the law, including online/email distribution. Usage is limited to the duration the ad is posted. No usage reports are required.

5.7. A posted ad is considered an invitation for third parties to submit offers for a deal on the stated terms.

5.8. Ads must fully comply with Support rules.

5.9. The User agrees to provide truthful information in posted ads. The User guarantees that the goods meet the standards of Russian law and the law of the buyer's country and are free from third-party rights. The User also guarantees that the offer does not infringe on legal rights or laws of the Russian Federation and confirms they have the right to post the ad.

5.10. Users must only use their personal account to post, edit, or delete ads and confirm they are the owner of the verified phone number.

5.11. Users are prohibited from posting ads for goods not in stock or for which they lack selling rights.

6. Website Usage

6.1. Like any software, the site may contain errors. The User agrees to use the site "as is" and assumes all associated risks. Support disclaims all warranties, including implied warranties of merchantability or fitness for a specific purpose.

6.2. Support is not liable for any information posted by Users or User actions.

7. Termination of the Agreement

7.1. Support may terminate this Agreement at any time for any reason, including violations or policy breaches.

7.2. The User may terminate the Agreement by ceasing use of the site and deleting their personal account.

8. Contact Information

8.1. As the User independently posts advertisements on the site, they are considered the advertiser and distributor under the Russian Federal Law "On Advertising" and the Code of Administrative Offenses.

8.2. The User guarantees they have the right to sell the advertised goods, including proper certification if required. Users are fully responsible for any breaches. Support may request proof (e.g., conformity declarations). Failure to provide proof may result in ad removal without penalty to Support.

8.3. The User is responsible for ensuring that ad content complies with Russian law, including the "Employment Law," "Advertising Law," and "Law on Protection of Children from Harmful Information." If third-party claims arise, the User agrees to resolve them independently at their own expense. The User must compensate Support for any losses incurred.

8.4. Given the technical complexity of user identification online, Support is not responsible for the accuracy of claimed user identities or any resulting damages.

8.5. By using the site, the User acknowledges and accepts the risk of inaccurate, offensive, or inappropriate content and decides independently whether to continue use.

8.6. Support does not guarantee that ads will be viewed by any specific number of users or even one user.

8.7. Support does not guarantee that the site’s software, servers, or networks are error- or virus-free. It is not responsible for data loss or equipment damage resulting from site use.

8.8. Support reserves the right to restrict or terminate access for Users violating this or any other site rule or advertising policy, including temporary or permanent suspension.

8.9. All disputes under this User Agreement are subject to resolution in a court located where the Support Service operates, in accordance with Russian law.

 

9. Dispute Resolution, Platform Involvement, and Secure Transactions

9.1. All disputes and disagreements arising between Users in connection with the conclusion, execution, or termination of transactions conducted via the Website shall be resolved by the Users independently without the involvement of the Service Provider, except in cases expressly provided for in this Agreement.

9.2. The Platform provides a secure transaction mechanism, under which funds from the Buyer are held in reserve until the product or service is confirmed as received. In the event of a disagreement between the parties within a secure transaction, either User may open a dispute through their personal account.

9.3. Upon initiation of a dispute, the Platform conducts an internal review. Both parties are obligated to provide all requested evidence (correspondence, photos, receipts, shipping documents, etc.). Based on the results of the investigation, the Platform will issue a decision on the dispute, which must be followed by both parties.

9.4. If either party is dissatisfied with the Platform's decision, they have the right to file a claim with their servicing bank in accordance with payment system rules or take the matter to court at the location of the other party or the Platform.

9.5. The Service Provider (Platform) is not a party to the transaction and is only responsible for the proper operation of the technical secure payment mechanism and the dispute resolution function within the provided framework.

9.6. Any disputes between the User and the Platform that cannot be resolved amicably shall be submitted to the court at the location of the Service Provider in accordance with the laws of the Russian Federation.

 

This Agreement shall not be interpreted as establishing any agency, partnership, joint venture, employment, or any other relationship between the Support Service and the User that is not explicitly provided for in this Agreement.
